The patient should be confined to his/her place of residence. The patient must be under the care of a licensed physician. The service must be deemed reasonable and necessary according to Medicare, Medicaid or insurance. There must be reasonable expectation that the medical needs of the patient can be met adequately in his/her residence.

The patient’s family or guardian may exercise the patient’s rights when the patient has been judged incompetent. The HIPAA Privacy Rule establishes national standards to protect individuals’ medical records and other personal health information and applies to health plans, health care clearinghouses, and those health care providers that conduct certain health care transactions electronically.
